What you should know about civil law & litigation

Deadlines matter
As a general rule, contractual claims must be brought within 10 years and claims for damages outside a contract within 5 years (Articles 2946 and 2947 of the Civil Code). Damage from road traffic accidents has a shorter 2-year limit.

A formal notice can stop the clock
A written demand (diffida or messa in mora) interrupts the limitation period, which then starts again from the beginning.

Mediation often comes first
For many disputes, including condominium, inheritance, lease and insurance matters, an attempt at mediation is a mandatory step before going to court (Legislative Decree 28/2010).

Evidence wins cases
Keep contracts, invoices, correspondence, photographs and witness details from the start. What can be proven matters as much as what happened.
