The earliest stage of a criminal matter is often the most important. Contact a lawyer as soon as you learn you are under investigation or have been summoned, and before giving any statement.
Article 27 of the Italian Constitution provides that a defendant is not considered guilty until a final conviction.
When questioned as a suspect you may choose not to answer, and you have the right to be assisted by a lawyer (Article 64 of the Code of Criminal Procedure).
When prosecutors close an investigation they serve a notice (avviso di conclusione delle indagini, Article 415-bis). You then have 20 days to review the file, file submissions or ask to be questioned.
A person harmed by an offence can join the proceedings as a civil party (parte civile) to seek compensation.
