What you should know about family & divorce law

Separation comes before divorce

Divorce can be requested 6 months after a consensual separation or 12 months after a judicial one (Law 55/2015). Since the 2022 reform, separation and divorce requests can be filed in the same proceedings.

Shared custody is the rule

Children have the right to a balanced relationship with both parents; joint custody (affidamento condiviso) is the norm unless it is against the child's interest.

Agreements can be reached without a judge

Through assisted negotiation (negoziazione assistita), each spouse's lawyer can help reach a separation or divorce agreement outside court.

Maintenance can be reviewed

Child support and spousal maintenance can be changed later if circumstances change significantly.
