What you should know about inheritance & succession

Close family members have protected shares

Under Italian law, a spouse, children and in some cases parents are entitled to a reserved share of the estate (legittima), even if a will says otherwise.

You can protect your own assets

An heir can accept an inheritance “with benefit of inventory” (beneficio d'inventario), so the estate's debts are paid only up to the value of what is inherited.

There are deadlines

The declaration of succession must generally be filed within 12 months of the death, and the right to accept an inheritance is generally lost after 10 years.

Estates abroad

For deaths since 17 August 2015, the EU Succession Regulation usually applies the law of the country where the person habitually lived, unless they chose the law of their nationality in a will.
